Terms of Service

FundMyCommunity ("Platform," "we," "us," or "our") is a crowdfunding platform owned and operated by My Path To Care LLC, a Texas limited liability company. The Platform enables individuals, organizations, and businesses ("Campaign Organizers") to create fundraising campaigns and allows supporters ("Donors") to contribute to those campaigns.

FundMyCommunity is a technology platform that facilitates connections between Campaign Organizers and Donors. We are not a broker, financial institution, creditor, charity, or nonprofit organization.

To use the Platform, you must:

1. Be at least 18 years of age;
2. Be a legal resident of the United States or have the legal capacity to enter into a binding agreement;
3. Provide accurate, truthful, and complete registration information;
4. Maintain the security of your account credentials.

You may not use the Platform if you have been previously suspended or removed from the Platform or if you are prohibited from using the Platform under applicable law.

By creating a campaign on FundMyCommunity, you represent and warrant that:

1. All information provided in your campaign, including but not limited to the campaign description, purpose, images, video content, goal amount, and intended use of funds, is truthful, accurate, and not misleading;
2. You will use all funds raised solely for the purpose stated in your campaign;
3. You have the legal right and authority to create the campaign and to receive and use funds for the stated purpose;
4. Your campaign does not violate any applicable local, state, or federal law;
5. You will provide updates to Donors regarding the use of funds if requested;
6. You are solely responsible for fulfilling any promises, rewards, or commitments made in your campaign.

Campaign Organizers who misrepresent the nature, purpose, or intended use of funds in their campaigns may be subject to immediate campaign removal, account suspension, fund withholding, and reporting to appropriate law enforcement authorities.

By making a donation on FundMyCommunity, you acknowledge and agree that:

1. Donations are made voluntarily and at your own risk;
2. FundMyCommunity does not guarantee that campaigns are legitimate, that Campaign Organizers will use funds as described, or that any particular outcome will result from your donation;
3. FundMyCommunity does not verify the accuracy of campaign content, the identity of Campaign Organizers beyond basic account verification, or the intended use of funds;
4. Donations are generally non-refundable once processed. Refund requests are handled on a case-by-case basis at the sole discretion of the Platform;
5. Donations to campaigns on FundMyCommunity are not tax-deductible unless the Campaign Organizer is a verified 501(c)(3) tax-exempt organization, and even then, tax deductibility is the responsibility of the Donor to confirm independently;
6. Any optional tip added to a donation is a voluntary payment to FundMyCommunity for use of the Platform and is non-refundable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. FUNDMYCOMMUNITY AND MY PATH TO CARE LLC, INCLUDING THEIR OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES, SHALL NOT BE LIABLE FOR ANY CLAIMS, DAMAGES, LOSSES, OR EXPENSES ARISING FROM OR RELATED TO:
   1. THE CONDUCT, ACTIONS, OR INACTIONS OF ANY CAMPAIGN ORGANIZER, INCLUDING BUT NOT LIMITED TO MISREPRESENTATION, FRAUD, MISUSE OF FUNDS, OR FAILURE TO DELIVER ON CAMPAIGN PROMISES;
   2. THE ACCURACY, COMPLETENESS, OR TRUTHFULNESS OF ANY CAMPAIGN CONTENT, DESCRIPTIONS, IMAGES, OR VIDEOS;
   3. ANY DISPUTE BETWEEN A DONOR AND A CAMPAIGN ORGANIZER;
   4. ANY LOSS OF DONATED FUNDS FOR ANY REASON;
   5. ANY INTERRUPTION, DELAY, OR FAILURE OF THE PLATFORM OR ITS SERVICES.
2. THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
3. IN NO EVENT SHALL THE TOTAL LIABILITY OF FUNDMYCOMMUNITY OR MY PATH TO CARE LLC EXCEED THE AMOUNT OF FEES ACTUALLY PAID BY YOU TO THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

The following types of campaigns are prohibited on FundMyCommunity:

1. Campaigns that promote violence, terrorism, hate speech, or discrimination;
2. Campaigns involving illegal activities, controlled substances, or weapons;
3. Campaigns that are fraudulent, deceptive, or misleading;
4. Campaigns for personal financial gain disguised as charitable causes;
5. Campaigns involving gambling, lotteries, or contests of chance;
6. Campaigns that infringe on the intellectual property rights of any third party;
7. Campaigns involving sexually explicit content or adult services;
8. Campaigns that solicit funds for political candidates or political action committees;
9. Campaigns that violate any applicable law or regulation.

FundMyCommunity reserves the right, at its sole discretion, to remove any campaign, withhold funds, or suspend any account that violates these Terms or that we reasonably believe to be fraudulent or harmful.

All payment processing on FundMyCommunity is handled by Stripe, Inc. ("Stripe"), a third-party payment processor. By using the Platform:

1. Campaign Organizers agree to Stripe's Connected Account Agreement and any applicable Stripe terms of service;
2. Donors agree to Stripe's terms of service with respect to payment processing;
3. FundMyCommunity is not responsible for errors, delays, or failures in payment processing caused by Stripe or any financial institution;
4. Standard payment processing fees are charged by Stripe and deducted from donations. FundMyCommunity does not charge a platform fee; revenue is generated through voluntary Donor tips;
5. Campaign Organizers are responsible for providing accurate banking and tax information to Stripe for fund disbursement. FundMyCommunity is not responsible for misdirected funds resulting from incorrect information provided by the Campaign Organizer.

1. The FundMyCommunity name, logo, and all related marks, designs, and content created by the Platform are the property of My Path To Care LLC;
2. By uploading content to the Platform (including text, images, and videos), you grant FundMyCommunity a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Platform and promoting your campaign;
3. You represent that you own or have the necessary rights to all content you upload and that such content does not infringe on the rights of any third party.

FundMyCommunity reserves the right to suspend or terminate your account at any time, with or without notice, for:

1. Violation of these Terms;
2. Fraudulent, misleading, or illegal activity;
3. Conduct that harms or threatens to harm other users or the Platform;
4. Any reason at our sole discretion.

Upon termination, any pending fund disbursements may be withheld pending investigation. You may also terminate your account at any time by contacting us, but this does not release you from any obligations for campaigns you have created or donations you have made.

You agree to indemnify, defend, and hold harmless FundMyCommunity, My Path To Care LLC, and their officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

1. Your use of the Platform;
2. Your violation of these Terms;
3. Any content you submit to the Platform;
4. Any campaign you create or donation you make;
5. Your violation of any applicable law or the rights of any third party.

1. Any dispute arising from or relating to these Terms or the use of the Platform shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions;
2. You agree to attempt to resolve any dispute informally by contacting us first;
3. If a dispute cannot be resolved informally within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Harris County, Texas;
4. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against FundMyCommunity or My Path To Care LLC;
5. Small claims court actions in Harris County, Texas are exempt from the arbitration requirement.

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. FundMyCommunity collects personal information necessary to operate the Platform, process payments, and comply with legal obligations. We do not sell your personal information to third parties.

FundMyCommunity reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform with an updated "Last Updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FundMyCommunity regarding your use of the Platform and supersede any prior agreements.
